Terms of Service

These terms are a binding agreement between KrakenVoice(“we”, “us”) and the business or person creating an account (“you”). By creating an account or using the service you accept these terms and our Privacy Policy. If you accept on behalf of a company, you confirm you have authority to bind it.

KrakenVoice provides an AI-powered voice receptionist that answers calls, records and transcribes conversations, books appointments, takes messages, and integrates with third-party business systems you choose to connect. Features may change as the product evolves; we will not materially reduce the core service you pay for during a paid term.

You are responsible for the accuracy of your account information, for maintaining the confidentiality of credentials, and for all activity under your workspace. Notify us promptly of any suspected unauthorized access.

• Call recording compliance. Calls handled by the service are recorded and transcribed. You are responsible for complying with all call recording, wiretapping, and consent laws that apply to your business and your callers (including one-party and two-party consent rules), and for providing any required recording notices.
• Telemarketing laws. If you use outbound calling features, you are responsible for complying with telemarketing and robocall laws (such as the TCPA), including consent and do-not-call requirements.
• Accurate business information. The AI receptionist answers using the information you provide or approve; you are responsible for keeping it accurate.
• Lawful use. You will not use the service to deceive callers about speaking with an AI where disclosure is required, harass anyone, or violate any law.

The service uses artificial intelligence. AI can mishear, misunderstand, or state things incorrectly. You should review call summaries and bookings before relying on them for important decisions.

The service is not for emergencies. It cannot place or route calls to emergency services, and you must not present it to callers as an emergency line.

Paid plans are billed through our payment processors (Stripe or Square) at the prices shown when you subscribe. Fees are non-refundable except where required by law. Subscriptions renew automatically until canceled; cancellation stops future renewals but does not refund the current period. We may suspend service for non-payment after reasonable notice.

You own your business data, call recordings, transcripts, and customer records. You grant us the rights needed to host, process, transmit, and display that data to operate and support the service, including processing by the sub-processors described in the Privacy Policy. Upon account closure you may request export or deletion of your data.

We retain all rights in the platform software, AI configurations, and branding. You receive a limited, non-exclusive, non-transferable right to use the service during your subscription. You may not reverse engineer, resell, or copy the service except as permitted in writing.

You may cancel at any time from billing settings. We may suspend or terminate access for material breach of these terms, unlawful use, or non-payment, with notice where practicable. Sections that by their nature should survive (data rights, disclaimers, liability limits) survive termination.

The service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that AI output will be accurate.

To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenue. Our total liability for all claims in any 12-month period is limited to the amounts you paid us for the service in that period.

You will defend and indemnify us against third-party claims arising from your breach of the “Your responsibilities” section, including claims that calls were recorded or placed without legally required consent.

We may update these terms; material changes will be announced in the platform at least 14 days before they take effect, and continued use after that constitutes acceptance. These terms are governed by the laws of the jurisdiction where the operating company is registered, excluding conflict-of-law rules.
